Verify newsletter compliance
Before you hand over your cash, make sure the seller isn't about to pass you a bunch of compliance issues. Email marketing laws are no joke, and ignorance won't protect you from hefty fines.
Check the following:
Confirm the newsletter complies with CAN-SPAM (US), GDPR (EU), and CASL (Canada). These are legal requirements and are not optional!
Subscriber consent: How did people get on this list? Were they required to opt in?
Unsubscribe process: Are unsubscribe requests honored promptly? Check that the process works by testing it yourself.
Privacy policy: Does one exist and does it cover data collection, storage, and sharing? Services like Mailchimp and Kit require you to have a privacy policy in place to use their platforms.
Data handling practices: Where is subscriber data stored? Who has access to it and is it encrypted?
You may also want to review:
Any affiliate disclosures
Labeling of sponsored content
spam reports, and
platform warnings
If the account has a history of violations, you may inherit deliverability problems.
Keep this checklist handy because it will help you identify a clean, compliant email list.
